Terms of Use

These Terms of Use (collectively the “Terms”) set forth the legally binding terms and conditions which are applicable to your use of the BEAM application (“App” or “Apps”) developed by Yauhen Smychkouski. In this policy, Yauhen Smychkouski may also be referred to as the “Developer”, “We”, or “Us”.

By installing, accessing or using the Apps, you confirm that you have read and understood the Terms and any other documents referred to herein, including without limitation our Privacy Policy, and that you agree to be bound by the Terms. If you do not agree to these Terms, you are not entitled to use the App, and you must uninstall and delete all copies from your device.

1. Medical Disclaimer (Important)

BEAM is designed for wellness, fitness, and cosmetic purposes only. The App, its workouts, face yoga routines, and any related content do not constitute medical advice, diagnosis, or treatment.

You should consult with a healthcare professional or dermatologist before starting any new fitness or facial exercise routine, especially if you have pre-existing medical conditions, skin issues, or have recently undergone facial surgery or cosmetic procedures (e.g., Botox, fillers). By using the App, you agree that you are performing these exercises at your own risk. We are not liable for any injuries, skin irritations, or damages resulting from the use of our App.

2. Subscriptions, Free Trials, and Billing

The App offers premium features available via auto-renewing subscriptions (e.g., Weekly, Monthly, or Yearly plans).

• Payment: Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless canceled at least 24 hours before the end of the current period.
• Account Charging: Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage and cancel your subscriptions by going to your App Store or Google Play Account Settings after purchase. Canceling a subscription does not grant a refund for the current billing period, but you will retain access to premium features until the period ends.
• Free Trials: If a free trial is offered, any unused portion will be forfeited when you purchase a premium subscription.

3. License and Restrictions

By downloading or using our Apps, you receive a personal, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes. You may not:

• copy, modify, distribute, or reverse engineer any part of the App;
• extract source code or make derivative works;
• use our trademarks or branding without permission.

All rights, titles, and interests in and to the App remain with Yauhen Smychkouski.

4. AI Features and Face Data

The App may include AI-based features (e.g., progress tracking or portrait generation). By uploading an image of your face or using the camera, you grant us a limited, temporary license to process the image for the sole purpose of generating the requested output or tracking exercises.

Image data is processed either locally or temporarily uploaded to our servers. All uploaded data is deleted shortly after generation is completed. We do not use your images to train AI models or share them with third parties.

5. Age-Restricted Content

The App is intended for users aged 17 and older. We rely on Apple’s and Google's platform mechanisms to enforce age access. We do not implement additional in-app age gating.

6. User Content and Responsibility

You are solely responsible for the content you upload and generate within the App. You agree not to upload images of other people without their consent or create offensive/illegal content.

7. Privacy and Data Use

Our Privacy Policy explains how we collect, use, and protect your data. By agreeing to these Terms, you also accept our Privacy Policy. We recommend that you do not jailbreak or root your device, as it may compromise security and functionality.

8. Service Availability and Updates

We may update or modify the App at any time and are not obligated to continue supporting any version. We may also terminate access to the App without prior notice. You agree to accept automatic updates to maintain compatibility.

9. Limitation of Liability

We strive to provide a functional and reliable App but do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, we are not liable for: device compatibility issues, connectivity charges, or third-party functionality.
